Divorce in Spain

In general, a divorce is an emotional process. However, legal dissolution is desirable and even necessary. A lawyer is an essential link in the whole process, as well as a requirement of the Spanish law. Experience, commitment and empathy are important for a good legal proceeding.

Just like divorce, legal separation in Spain is a solution to a situation that evidences the impossibility of the spouses of living together. In case of mutual agreement, a petition for separation may be filed if at least one year has elapsed after the wedding.

If there is no mutual agreement, divorce may be sought by one of the spouses claiming any one of the reasons listed for legal separation.

Reasons for legal separation:

  • Abandonment of marital home, infidelity, offensive or humiliating treatment,
    as well as any other serious or repeated failure to fulfil marital duties;
  • Serious or repeated failure to fulfil the duties related to the children in common or to the children of one of the spouses that were living with the family;
  • Sentence with imprisonment for more than six years;
  • Alcoholism, drug addiction and/or mental instability, when the couple should stop
    living together in the interest of the other spouse or the family;
  • When the couple has agreed to stop living together and has been living apart for at least six months;
  • When the couple has actually stopped living together for at least three years.
