If you are involved in a traffic accident in Spain, the procedure will be different from that followed in the Netherlands, as in Spain the statute of limitations runs for only one year.

When comparing with the Netherlands, the victim of a traffic accident there has a period of three years before the lapse of statute of limitations for his/her claims, under the Motor Vehicle Liability Insurance Law, and five years pursuant to the Civil Code.

In Spain someone should be held liable before the first year has elapsed. During the first six months, a police report is produced. A criminal complaint is typically the form used in Spain, but the term of filing expires six months after the date of the accident. Therefore it is important to act quickly. It should also be taken into account that a notarial record must sometimes be drawn, so a nearby notary should be found to certify the power of attorney together with the victim. This process will also take a long time (considering the fact that translations will be required as well).
