If you, as an employer, carry out activities in Spain and are going to draft an employment contract in accordance with Spanish law, you should bear in mind that Spanish Labour Law differs considerably from Dutch Labour Law in several aspects. In addition to Spanish Labour Law, a collective agreement that deviates from the law at different points almost always applies. Taking into account the Spanish system, we can draw up an employment contract for you in accordance with Spanish law, and, if you wish, we can take into account working conditions as you apply them in the Netherlands. This way, there may be a certain degree of harmonization regarding working conditions. We can also manage your payroll administration.
If you, as an employee, are about to sign an employment contract under Spanish law, we can verify the employment contract and advise you on it. Our office has wide experience in drafting and evaluating general conditions under Spanish law. We usually use, where appropriate, the Dutch general conditions as a starting point and modify them in accordance with Spanish law.
In this case, it is important to make a distinction between consumers and non-consumers. If there are general conditions in which the opposite party is a consumer, Spanish law offers much more extensive protection than in the case of a “business to business” relationship.
